1. About these terms
These terms apply to your use of hugephotocollage.com (the "Site") and to anything you buy from it. The Site is operated by DigiAppsPH Software Publishing ("we", "us"), a sole proprietorship of Jeffrey Ignacio registered with the Department of Trade and Industry, of Unit 1716 Tower 2, Avida Towers Prime Taft, 2643 Taft Avenue, Pasay City, Metro Manila 1306, Philippines. By using the Site or placing an order, you agree to these terms, our Privacy Policy and our Refund Policy. You must be at least 18 years old, or the age of majority where you live, to place an order.
2. What we sell
We sell digital collage templates. Each template is a PowerPoint (.pptx) file, built to the template, size, orientation and wording you choose in our designer. It is filled with sample photos that you replace with your own in Canva, which is a separate service. You then download a print-ready PDF from Canva and have it printed wherever you like. We do not print, frame or ship anything.
Preview images in our designer, including any preview made with your own photos, are for guidance. What is printed depends on the photos you use, your Canva settings and your print provider.
3. Using Canva
You need your own Canva account to use a template. Canva's own terms govern that account. We are not affiliated with, sponsored by or endorsed by Canva, and we are not responsible for Canva's availability, features, limits or pricing. Our templates are designed to work on a free Canva account as it operates at the date of purchase. If a later change by Canva stops a template working, contact us and we will try to help.
4. Orders, prices and payment
- Prices are in US dollars unless shown otherwise at checkout. Sales tax or VAT is added at checkout where the law requires it.
- Your order is accepted when payment is confirmed and your download link is sent. We may cancel and fully refund an order if a product was listed at an obviously wrong price, or if we reasonably suspect fraud.
- Payments are processed by the payment providers shown at checkout. We never see or store your full card details.
5. Delivery
Your download link arrives in your order confirmation email and on your order status page, as described in our Shipping Policy. By completing checkout, you ask us to deliver your file immediately. If you are in the European Union or the United Kingdom, you acknowledge that your 14-day right to withdraw ends when delivery begins. Your rights for faulty digital content are not affected.
6. Your licence to use a template
When you buy a template, we grant you a personal, non-exclusive, non-transferable licence to:
- open and edit the template in Canva or PowerPoint, and replace its photos and text;
- print the finished collage, in any quantity, for personal use or as a gift, using any print provider; and
- share images of your finished collage, for example on social media.
You may not:
- resell, share, sublicense or give away the template file, or any template derived from it, whether or not it has been edited;
- use the template to make collages for paying clients, or offer it as part of a commercial service, without a commercial licence from us (please ask); or
- extract and reuse our layouts, shapes or outlines separately from the collage you make.
The sample photos in each template are placeholders. You may leave some in place in the collage you print for yourself, but you may not use them in any other way.
7. Your photos
Your photos remain yours. When you try a design with your own photos, they are processed only in your browser and are never uploaded to us. You add photos to the template yourself, in Canva. You are responsible for having the right to use the photos and any text you add. Do not use photos or text that infringe someone else's rights or that are unlawful.
8. Our intellectual property
The Site and its designer, and our templates, layouts, shapes and outlines, belong to us or our licensors. Apart from the licence in section 6, you acquire no rights in them. Canva and PowerPoint are trademarks of their respective owners.
9. Refunds
Refunds are covered by our Refund Policy, including our faulty-file guarantee.
10. Disclaimers and limitation of liability
Except as stated in these terms and our Refund Policy, and to the extent the law allows, templates are provided "as is". We do not promise that a particular print, frame or display will match the on-screen preview exactly.
To the extent the law allows, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, or for printing costs you pay to third parties. Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, or any right you have as a consumer under the law of the country where you live.
11. Use of the Site
You agree not to misuse the Site. That includes attempting to access orders or downloads that are not yours, interfering with its operation, or copying the designer or its templates by automated means.
12. Governing law and disputes
These terms are governed by the laws of the Republic of the Philippines. If a dispute arises, please contact us first: we aim to resolve every issue directly. Disputes that cannot be resolved by agreement are subject to the courts of Pasay City, Metro Manila. If you are a consumer living in another country, you keep the protection of that country's mandatory consumer laws and may bring a claim in your local courts where the law allows.
13. Changes to these terms
We may update these terms from time to time. Every order is governed by the version in force when it is placed. The date at the top shows when these terms last changed.
